Legislation initiated to revise divorce and child-support rules by the Liberals

Justice Minister Jody Wilson Raybould says the new introduced measures- the first major update to Canada’s family laws in 20 years – would help in giving the courts an option of accessing more information about the income levels of parents. The Federal Government is initiating purely new family legislation which aims at helping families settle their disputes outside court, improve well being of impacted children, and also improve child support.

According to Wilson-Raybould, on seeking enforcement of child support payments, THE Bill C-78 would allow an application to the CRA (Canadian Revenue Agency) when deciding the appropriate amount for settlements both in and out of the court. She further added that the proposed bill would incite parties to use methods other than court system, such as mediation services and dispute resolution.

This bill also proposes more “child focused” language, that replaces fuel conflicting words with other child friendly words. This new legislation promised to make changes to the Family Orders and Agreements Enforcement Assistance Act and Garnishment, Attachment and Pension Diversion Act and the Divorce Act. The Legislation will also require courts to set  family violence and quite a number of other important factors into motion right after this bill is passed.
